Terms and conditions: photo restoration and media transfer

Last updated: October 2026

These terms apply to consumer orders placed with David Clements trading as DCD Photo Restoration & Video Tape Transfer (“DCD”, “I”, “me”). By accepting a quote, placing an order or asking me to begin work, you agree to these terms. I will also provide the applicable terms and order details by email or another format you can save.

1. Contact and service area

DCD is a sole-trader business based in Chorley, Lancashire. Contact me at daveclementsdesign@gmail.com or 07941 419792. I accept orders from The United Kingdom. International orders are considered on a case-by-case basis

2. Services and accepted media

I provide the specific work described in your written quote or order confirmation. Services may include photo scanning/restoration, transfer of VHS, VHS-C, 8mm and Mini DV camcorder tapes, DVD and digitisation of Standard 8 and Super 8 cine film.

The quote/confirmation will identify the items, requested work, price or method of calculation, delivery format and any known limitations. I may decline media I cannot safely or competently process.

Photo prints: Photo prints are available by separate quotation. The quote will confirm the print size, price and whether the prints will be posted or collected. Colours and appearance may vary slightly between the image shown on your screen and the finished print because screens and printers display and reproduce colour differently. I cannot guarantee an exact match to your screen, but I will produce the prints with reasonable care and skill. Postage or collection arrangements will be agreed with you before you place the order.

3. Quotes, price and payment

Prices are shown in pounds sterling. Consumer prices include VAT where applicable. DCD is not VAT registered. Postage, return delivery, optional cleaning, extra restoration or other additional work will be stated before you become liable for it. Where a price depends on inspection or condition, I will explain the calculation and give you a quote before chargeable work begins.

Quotes are valid for 28 days. Work begins after quote approval. Payment is due when the work is complete using bank transfer or another agreed method. I will not start additional chargeable work without your approval. If a payment is overdue, I may pause work after giving reasonable notice, subject to your statutory rights.

4. Condition, cleaning and quality limitations

Condition and risks of processing: Many photographs, tapes and cine films are old and may be fragile or deteriorated. Age, wear, mould, dirt, previous damage or repairs, and the condition of the recording may affect the results and may mean that some material cannot be recovered. Processing may reveal or worsen pre-existing faults, and I cannot guarantee that every item will play, scan or transfer successfully. I will use reasonable care and skill, inspect items where practical, and contact you before proceeding if I identify a significant risk of further damage or think specialist cleaning or handling is needed. Any extra charge will be agreed with you first. Transfer cannot add detail or sound that is not present in the source. Restoration involves judgement; a result may not match every customer’s preference or an unknowable original appearance. This does not affect your statutory rights.

I will use reasonable care and skill and carry out the work agreed. I do not guarantee a particular improvement, recovery of all content or a specific aesthetic result unless I expressly agree that in writing. These limitations do not remove your statutory rights or excuse a failure to use reasonable care and skill.

I will inspect items when reasonably practical. If I find mould, contamination or damage that may make playback unsafe or risk further damage, I may stop and contact you. Cleaning or specialist handling costs pricing starts at £15 and will only be charged with your approval. If you do not approve the proposed work, I will return the item or arrange collection, and charge only any disclosed inspection, return-postage or work already properly authorised and legally payable.

AI-assisted edits: Some restoration work may use generative AI to help repair or recreate parts of an image. AI may interpret details that are unclear or missing, so an edited result may not be an exact record of how the photograph originally looked. I will use reasonable care and skill and will discuss significant changes or concerns with you where practical. Please tell me before work begins if you do not want generative AI used on your images.

5. Your originals, postage and collection

You remain the owner of your physical originals. I will take reasonable care of them while they are in my possession and use them only to carry out your order. Please pack posted items securely and use Royal Mail tracked or signed for services for irreplaceable originals. Inbound postage is paid by the customer; return postage is paid by customer.

I will return originals by post or DCD pick up and drop-off to the address you confirm, or make them available for collection at Triumph Avenue, Chorley. My estimated return time is 7 working days after completion and payment. I will contact you if there is a delay or a parcel is returned undelivered.

I will package return items with reasonable care. Postage and courier services involve risks outside my control. Any claim about an item lost or damaged in transit will be handled with the carrier and under applicable law. Nothing here excludes liability that cannot lawfully be excluded.

6. Delivery of digital files

Completed image files will be supplied as JPEGS by email. Completed video files will be supplied as MP$ files by USB drive. You should make and keep your own backup promptly. I retain my working/final copies for the periods described in the Privacy Notice. After that, I may be unable to provide another copy. Tell me promptly if a file is corrupt or inaccessible so I can investigate.

7. Cancellations and consumer rights

If you are a consumer and make a distance or off-premises contract, you will generally have 14 days from the day the contract is made to cancel. If you ask me to begin the service within that period and then cancel, you may have to pay a proportionate amount for the service provided up to cancellation, but only where the statutory requirements have been met. When a service has been fully performed following your express prior consent and acknowledgement, the statutory cancellation right for that service ends.

Where the order includes digital files supplied by download or link, I will not start supplying those files during the cancellation period unless you expressly consent and acknowledge that your cancellation right for that digital content will be lost once supply begins. If the work is a combined service and digital-content supply, I will explain which cancellation rules apply to each part before you order.

Nothing in these terms reduces your rights under the Consumer Rights Act 2015 or other applicable law. In particular, services must be performed with reasonable care and skill and information about the service may form part of the contract.

8. Changes, delays and ending an order

If I discover that the work differs materially from the quote or that extra work is needed, I will pause and ask for your agreement to any price or scope change. Estimated turnaround is 7-10 working days from approval date .It is an estimate unless a firm date is expressly agreed. I will let you know about a significant delay and discuss options. Either of us may contact the other to resolve a problem or end work where permitted by law. Any payment or refund will reflect the work performed and the applicable consumer rights.

9. Copyright and permissions

You confirm that you own the items or have the necessary authority and permissions to give them to me and request the copying, restoration and format-shifting described in the order. You are responsible for ensuring your instructions and requested use are lawful.

Material I cannot process: I may refuse or stop work if I reasonably believe an item or requested transfer contains material that is unlawful to copy, possess or distribute, or if processing it could put me or another person at legal risk. Where practical, I will contact you, explain that I cannot continue and arrange the return or collection of your original. Any refund or charge for work already completed will be handled in line with the law and the rest of these terms.

You retain ownership of your physical originals and any copyright you already own in material you supply. Payment for the service does not transfer to DCD any copyright in your originals or grant DCD permission to publicise them. I will not use your material for a portfolio, promotion, social media or other public display without your separate permission.

10. Complaints

If something is wrong, please contact daveclementsdesign@gmail.com with your order reference and a description of the problem. I will acknowledge your complaint within 5 working days and aim to provide a full response within 10 working days. If I need longer, I will explain why and when I expect to respond. I will consider the agreed specification, source condition, files/items and applicable legal rights, then explain my proposed next steps.

11. Privacy

I use personal information in accordance with the Privacy Notice. Your order material is used to perform the service and is not used in advertising without separate permission.

12. Applicable law

These terms are governed by the law of England and Wales. If you are a consumer resident elsewhere in the UK, you retain any mandatory protections available under the law that applies to you. Any dispute may be brought before a court with appropriate jurisdiction.
